IN NO EVENT SHALL THIARTI’S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO THIARTI FOR THE PRODUCT AT ISSUE OR (B) $100.

You agree to defend, indemnify, and hold harmless Thiarti and its officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site or violation of these Terms.

Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located within the State of New York, and you consent to the personal jurisdiction and venue of such courts.

13. JURISDICTIONAL USE

The Site is controlled and operated from within the United States. We make no representations that the Site is appropriate or available for use in other locations. Those who access the Site from outside the United States do so at their own initiative and are responsible for compliance with local laws.

14. SEVERABILITY

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.
